Demo application limitation

The demo application is provided only for evaluation, demonstration, testing, design review, and discussion purposes. It must not be used for real clinical care, urgent communication, medical decision-making, storage of production patient records, or as a reliable archive of health information unless a separate written pilot or service agreement is in place.

Unless and until a formal legal entity is registered, OrthoCompanion is not operated through a limited-liability company. Any commercial pilot, subscription, clinic dashboard access, professional use, or data-processing arrangement requires a separate written agreement.

No contract by website or demo use

Access to this website, the demo application, informational material, product descriptions, screenshots, or prototype features does not create any contract, mandate, treatment relationship, patient relationship, clinic relationship, subscription, pilot agreement, service-level commitment, support obligation, or professional obligation.

Any pilot, paid subscription, clinic dashboard access, data-processing arrangement, production deployment, or professional use must be governed by a separate written agreement signed or expressly accepted by the relevant parties.

Medical and clinical disclaimer

OrthoCompanion is intended to support communication, organization, appointment preparation, and follow-up between orthodontic patients and orthodontic professionals. It does not provide medical advice, diagnosis, treatment recommendations, clinical alerts, emergency monitoring, automated clinical decision-making, or a substitute for professional orthodontic judgment.

Orthodontic professionals remain solely responsible for all clinical decisions, treatment plans, patient instructions, diagnosis, treatment monitoring, and interpretation of patient-provided information.

Patients must follow the instructions of their orthodontist or qualified healthcare professional. OrthoCompanion must not be used in emergencies or as a substitute for direct professional care.

Data protection and privacy

Personal data is processed only to the extent necessary for operating the website, demo application, communication, account management, pilot evaluation, technical security, troubleshooting, and service improvement.

Health-related or patient-related data should not be entered into the demo application unless a specific written agreement and appropriate data-processing framework are in place.

Where OrthoCompanion processes data on behalf of an orthodontic practice, clinic, or other professional organization, the respective roles, responsibilities, security measures, retention rules, access rights, deletion rules, and data-processing terms must be defined in a separate written agreement.

Users should not submit unnecessary sensitive personal data, medical records, emergency information, or confidential clinical information through general contact forms, demo fields, or unsupported channels.

Liability limitation

To the maximum extent permitted by applicable law, OrthoCompanion and the persons carrying the project exclude liability for indirect, consequential, incidental, punitive, or special damages, loss of profit, loss of revenue, loss of data, business interruption, treatment delay, clinical misunderstanding, reliance on incomplete, inaccurate, delayed, or unavailable information, or unauthorized use of the website or demo application.

Any liability arising from a paid pilot, subscription, clinic deployment, dashboard access, data-processing arrangement, or professional use must be governed by the applicable written agreement. In the absence of such an agreement, OrthoCompanion is provided without warranty, availability commitment, support commitment, service-level commitment, data-retention commitment, or fitness-for-purpose guarantee.

Nothing in this notice excludes liability where exclusion is not permitted by applicable law.

Availability and no warranty

The website and demo application may be changed, suspended, restricted, or discontinued at any time. OrthoCompanion does not guarantee uninterrupted availability, error-free operation, data completeness, data accuracy, compatibility with all devices, continued access to any feature, or preservation of demo data.

Account and user responsibility

Users are responsible for the accuracy, relevance, and lawfulness of information they enter. Users must not enter information about third parties unless they are authorized to do so. Users must not use OrthoCompanion for unlawful, harmful, misleading, abusive, or unauthorized purposes.

Intellectual property

All software, designs, text, trademarks, logos, workflows, documentation, screenshots, prototypes, and other materials made available through OrthoCompanion remain the property of their respective owners or project carriers unless otherwise stated. No rights are transferred except as expressly provided in a separate written agreement.

Copying, reproducing, modifying, reverse engineering, distributing, or commercially using OrthoCompanion materials without authorization is prohibited, except where mandatory law provides otherwise.

Third-party services

OrthoCompanion may rely on third-party infrastructure, hosting, analytics, communication, authentication, payment, app-store, or security providers. Their availability, security, and terms may apply independently.

Prices, subscriptions, and pilots

Any prices, subscription models, bundles, pilot fees, discounts, or commercial offers shown on the website or discussed in product material are non-binding unless confirmed in a separate written agreement or formal order process.

Governing law and jurisdiction

This legal notice is governed by Swiss law, subject to mandatory applicable law. Unless mandatory law provides otherwise, the place of jurisdiction is Aigle, Vaud, Switzerland.
